4.2 Each User may hold only one Account. Accounts are personal to you and may not be sold, transferred, or shared with any other person.

4.4 MOOIE will never request your OTP, CVV, PIN, or complete card/bank account details by phone call, SMS, WhatsApp, or email. Any such request should be treated as fraudulent and reported to us. 

5. Products, Pricing & Availability 

5.1 We take reasonable care to ensure that Product descriptions, images, ingredient lists, and pricing displayed on the Website are accurate. However, we do not warrant that this information is always complete, current, or error-free. Actual packaging, colour, or texture may vary slightly from images shown, due to display settings, batch variation, or formulation updates made in the ordinary course of business. 

5.2 All prices are listed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise. Delivery charges, if applicable, are shown separately at checkout as per our Shipping Policy. You are responsible for any additional taxes or duties applicable to your Order under law. 

5.3 Prices, offers, and Product availability are subject to change without prior notice and at our sole discretion. Where a Product is listed at an incorrect price due to a typographical, technical, or pricing error, we reserve the right to cancel the affected Order, whether payment has been processed or not. 

5.4 Discount codes, promotional offers, and free-gift-with-purchase offers are governed by their own specific terms where applicable, are non-transferable, and unless expressly stated otherwise, only one promotional code, offer, or discount may be applied per Order. We reserve the right to modify or withdraw any offer at any time without liability. 

5.5 We reserve the right, at our sole discretion, to limit the quantity of any Product purchasable per person, per Account, or per Order. 

6. Order Placement & Acceptance 

6.1 Products displayed on the Website constitute an invitation to offer and not an offer for sale. Placing an Order constitutes your offer to purchase the selected Product(s), which we may accept or decline at our sole discretion. 

6.2 No act of MOOIE prior to dispatch, including Order confirmation, payment processing, or any communication, constitutes acceptance of your offer. Our acceptance of your Order is deemed complete only upon dispatch of the Product(s). Where an Order is dispatched in multiple shipments, each dispatched portion is accepted independently. 

6.3 We reserve the right to cancel any Order, in whole or part, prior to dispatch for reasons including but not limited to Product unavailability, suspected fraudulent activity, inability to service the delivery address, or pricing/listing errors.  

7. Payment Terms 

7.1 Payment for Orders may be made via the methods offered at checkout, which may include credit/debit cards, UPI, net banking, digital wallets, and Cash on Delivery (where available). 

7.2 All online payments are processed through third-party payment gateway partners. MOOIE does not collect or store your complete card or banking credentials. 

7.3 You represent and warrant that any payment information and instrument you use is your own or that you are authorized to use it, and that all information provided is accurate. MOOIE shall not be liable for any loss arising from unauthorized or fraudulent use of a payment instrument by a third party. 

8. Shipping & Delivery 

8.1 Shipping timelines, serviceable locations, and delivery charges are set out in our Shipping Policy, incorporated herein by reference. 

8.2 Estimated delivery timelines are indicative and not guaranteed. MOOIE shall not be liable for delays arising from courier operations, incomplete or incorrect address information, force majeure events, or other circumstances beyond our reasonable control. 

8.3 Risk of loss and title to Products pass to you upon delivery to the address provided at checkout. 

9. Cancellation, Returns, Refunds & Replacements 

9.1 This clause should be read together with our Exchange Policy, incorporated herein by reference. 

9.2 You may cancel an Order at no cost at any time prior to dispatch, via your Account or by contacting customer support, and any amount already paid will be refunded in full. 

9.3 As our Products are skin care, for reasons of hygiene and consumer safety, MOOIE does not accept returns or issue refunds once an Order has been delivered, including for unopened Products. 

9.4 Notwithstanding clause 9.3, where a Product is received damaged, defective, expired, or materially different from what was ordered, please notify us with photographic evidence within 48 hours of delivery, and we will arrange a free replacement at no cost to you and no cash refund will be issued. 

10. Product Use, Health & Safety Disclaimer 

10.1 MOOIE face wash and skincare Products are formulated for external, topical use only and are not intended to diagnose, treat, cure, or prevent any medical condition. Nothing on the Website constitutes medical or dermatological advice. 

10.2 We recommend performing a patch test prior to first use, applying a small quantity to the inner forearm and observing for 24-48 hours, particularly for Users with sensitive skin, known allergies, or pre-existing dermatological conditions. 

10.3 Discontinue use immediately and consult a qualified dermatologist or physician if you experience irritation, redness, itching, or any adverse reaction. 

10.4 Cosmetic outcomes vary between individuals depending on skin type, usage pattern, and other factors; MOOIE makes no representation or warranty as to specific results. No advice, whether oral or written, obtained from MOOIE or through the Website creates any warranty not expressly stated in the accompanying Product documentation. 

10.5 Keep all Products out of reach of children. Avoid contact with eyes ; in case of accidental contact, rinse thoroughly with water and seek medical attention if irritation persists. Store Products as directed on the packaging and discontinue use after the indicated expiry or period-after-opening date. 

11. Intellectual Property Rights 

11.1 All Content on the Website, including the MOOIE name, logo, trademarks, product photography, packaging design, and written material, is the exclusive property of MOOIE or its licensors and is protected under applicable Indian intellectual property laws. 

11.2 You are granted a limited, non-exclusive, non-transferable licence to access and use the Website for personal, non-commercial purposes only. You may not reproduce, republish, distribute, modify, or commercially exploit any Content without our prior written consent.

12. User-Generated Content 

12.1 By submitting a product review, rating, comment, photograph, or other content to the Website, or by tagging MOOIE in social media posts, you grant MOOIE a worldwide, royalty-free, non-exclusive, perpetual, and sub-licensable licence to use, reproduce, adapt, publish, and display such content, including for marketing purposes, without further compensation to you. 

12.2 You represent that any content you submit is your own original work, is accurate, does not infringe any third party's rights, and is not unlawful, defamatory, or otherwise objectionable. MOOIE reserves the right, but has no obligation, to monitor, edit, or remove user-submitted content at its discretion. 

13. Prohibited Conduct 

You agree not to use the Website to: 

(a) violate any applicable law, rule, or regulation, or infringe any third party's rights, including intellectual property rights; (b) transmit content that is unlawful, obscene, defamatory, harassing, or otherwise objectionable; (c) attempt to gain unauthorised access to the Website, its systems, other Users' Accounts, or any connected network; (d) use bots, spiders, scrapers, or other automated means to access or extract data from the Website; (e) transmit spam, chain letters, or unsolicited commercial communications through the Website; or (f) impersonate any person or entity, or misrepresent your affiliation with any person or entity. 

We reserve the right to suspend or terminate access for any User found to be in violation of this clause.

17. Limitation of Liability 

To the maximum extent permitted under applicable law, MOOIE and its employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profit, loss of data, or loss of goodwill, arising out of or in connection with your use of the Website or Products. MOOIE's total aggregate liability arising out of any claim relating to an Order shall not exceed the amount actually paid by you for that Order. This limitation does not exclude or limit any liability that cannot lawfully be excluded, including liability for defective goods under the Consumer Protection Act, 2019. 

18. Indemnification 

You agree to defend, indemnify, and hold harmless MOOIE, its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with: (a) your breach of these Terms; (b) your misuse of the Website; (c) any content you submit; or (d) your violation of any applicable law or third-party right. This clause survives termination of these Terms. 

19. Force Majeure 

MOOIE shall not be held liable or responsible for any failure or delay in performance of its obligations under these Terms resulting from causes beyond its reasonable control, including acts of God, natural disaster, pandemic or epidemic, war, civil unrest, strikes, government action, internet or telecommunications failure, or cyber-attack. Performance shall be suspended for the duration of such an event. 

20. Termination 

We reserve the right to suspend or terminate your Account or access to the Website at any time, with or without notice, where we reasonably believe these Terms have been violated. Termination does not affect any obligations that arose prior to termination, including payment obligations for Orders already placed, nor does it affect any statutory rights you may have as a consumer. 

21. Governing Law & Dispute Resolution 

21.1 These Terms shall be governed by and construed in accordance with the laws of India. 

21.2 Subject to clause 21.3, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Coimbatore, Tamil Nadu, India. 

21.3 Any dispute shall first be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by MOOIE, seated at Coimbatore, in the English language. Each party shall bear its own costs of arbitration. 

22. General Provisions 

22.1 Severability. If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect. 

22.2 Entire Agreement. These Terms, together with the Policies referenced herein, constitute the entire agreement between you and MOOIE regarding your use of the Website, superseding any prior understanding. 

22.3 No Waiver. MOOIE's failure to enforce any provision of these Terms shall not be construed as a waiver of that or any other provision. 

22.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. MOOIE may assign these Terms to any successor entity or affiliate without notice. 

22.5 Domestic Use. MOOIE makes no representation that the Website or Products are appropriate for use outside India. Users accessing the Website from outside India do so at their own risk and are responsible for compliance with applicable local laws.
